Justice Blurred: Is the web of injustice in Benton County an ongoing enterprise?






(Editor's note: We need to dig a a little deeper in the outrageous injustices and indignities that have been heaped upon my friend and co-worker LaDonna Humphrey by Anthony Christopher, Circuit Court Judge Xollie Duncan and the various (and nefarious) associates of both parties. In this installment, let's turn the spotlight on the bench of the Benton County Circuit Court.)


As I last touched on, LaDonna Humphrey was sentenced to serve 10 days in jail for violating a November 9th order put in place by Judge Xollie Duncan.


Let’s recap:


1. Humphrey’s purse was stolen on the evening of November 8, 2019. Inside the purse was her iPhone.


2. Humphrey’s iPhone was not pass code protected.


3. In the contacts portion of Humphrey’s phone, she had listed out her passwords to all of her important accounts: Gmail, Apple ID, Utilities, you name it.


4. The purse/phone thief had full access to her phone AND her passwords.


5. On November 9, 2019 when standing in the AT&T store to purchase a new phone, Humphrey discovered that she could not access her Apple ID.


Fast forward to a hearing before Judge Xollie Duncan where Christopher and his legal team accused Humphrey of deleting her Apple ID – in fact, Christopher’s expert went as far as to say that an Apple ID can only be deleted by calling Apple Support.


He went on to falsely testify that once you call Apple ID to delete an account you must also provide credit card information.


These statements are absolutely false.


According to the official Apple website, these are the steps to delete an Apple ID:


“How to permanently delete your Apple ID


Sign in to your Apple ID account page on a Mac, PC, iPhone, or iPad. Then scroll down to Data and Privacy and select "Manage Your Data and Privacy." On the following page, select "Get started" under "Delete your account."


When you request account deletion, you'll receive a unique alphanumeric access code. Make sure that you keep this access code in a safe place. For a short period of time while your request is being processed, you can contact Apple Support, provide your access code, and we’ll help you cancel your request so you can resume using your Apple ID. “


Just to be sure, I called Apple to find out for myself. It is not necessary to call Apple to delete an ID. It can be done easily with these tools: the user email address and the pass code.


Humphrey’s phone thief had all of these tools. It's also noted that the description of the vehicle seen leaving the scene of the theft from Humprhey's vehicle was consistent with a vehicle Anthony Christopher "traded in" the following day.


Humphrey even provided proof to the court of a screen shot of what happened when she tried to log in to her Apple ID. She received a message that the Apple ID "was not associated" with an account.


Humphrey also hired her own expert who testified in court that an Apple ID can easily be deleted online with just an email and a password.


Something even more interesting to note: Christopher’s legal team provided a sworn statement by one computer forensics specialist but when it came time for court, Christopher brought in a different expert. The original expert was nowhere to be seen. I believe in the business world that is called a “bait and switch.”


Today in Fort Smith has attempted to track down the name of the "initial" expert that was going to testify about the technical information. Is it possible that expert's intended testimony didn't dovetail with the agenda of Anthony, his attorney and, seemingly, the court?


Judge Duncan didn’t even request to have someone show her how to delete an Apple ID.


It seems to me that Judge Duncan chose to turn a blind eye to the truth or made some crucial errors in judgement.


Either way, justice was blurred.


I would like to report that this is out of character for Judge Duncan; however, it seems to be a disturbing pattern.


Let’s go back in time to February 2009 when Fort Smith police found Sarah Fennell unconscious. Fennell was with her then boyfriend, Adam Kuettel. After several days in a coma, Fennell died. Her cause of death was ruled as “natural causes” by state medical officials. (Today in Fort Smith has reported on this story multiple times).


Fennell’s uncle, James Steward, was not convinced by the investigation, and he created a website called Justice4Sarah that published several incriminating documents from his niece’s death investigations.


Adam Kuettel was unhappy with Fennell’s Uncle and the website. According to the website, Fennell died after a beating from Kuettel and that investigators refused to hold Kuettel accountable.


This is where Judge Duncan comes in to play.


In February of 2012, Kuettel filed suit in Benton County, asking for damages because of emotional and personal distress.


On June 28, Duncan ruled for Kuettel and mandated that Steward remove all statements from the Internet.

Once again, justice seems a little out of focus.


In a twist of irony, Humphrey, as one of the reporters for Today in Fort Smith, has written extensively about the Fennell case.


Everything she had written about Fennell’s death was prior to her being sued by Anthony Christopher. And as part of her job in reporting on the case, Humphrey has written to Judge Duncan at least a dozen times – each time she has received no response.


When asked for a comment regarding this twist of irony in the case, Humphrey had this to say: “I have no comment.”


Humphrey may not have anything to say, but I do.


I am questioning the judgement of Judge Xollie Duncan. I question her judgement +in the Steward case (Fennell’s Uncle), in the Humphrey case, and in the case of Trent Reicks.


In the Reicks case, Judge Duncan gave his child away to a couple that were both lawyers…. One was lawyer for Wright, Lindsey and Jennings.

Why is this important?


It’s simple. In the suit against Humphrey, Anthony Christopher was represented by attorneys from Wright, Lindsey and Jennings.


Are you beginning to see the pattern?


It gets better (or maybe worse)… when you also understand that Christopher has followed Humphrey to Bankruptcy court to battle her there. According to public records for Bankruptcy Court, Humphrey was assigned a trustee to oversee her bankruptcy.


This trustee for the Bankruptcy Court is named Bianca Rucker.


Guess where Bianca Rucker worked prior to becoming the trustee in Bankruptcy Court?


You guessed it… Wright, Lindsey and Jennings. The same firm that employees her friend Glenn Ritter. The attorney for Anthony Christopher.


Once again...justice seems a little fuzzy.


Let me leave you with this cliff hanger:


Bianca Rucker is the trustee who sold Humphrey’s counter claim and right to appeal the outrageous judgment that was handed down by Judge Xollie Duncan in a case in which a 3$ million-plus finding went against Humphrey for slander and libel...for blowing the whistle on what turned out to be the truth.


Think about that one.
